The ACREL Report: Deed Project (December 2024)
This Report explores the uses and interpretations of special warranty deeds (and to some extent deeds generally) in the United States. In the process of preparing The ACREL Report on purchase and sale agreements, we realized that many misconceptions and misunderstandings seem to exist regarding the deeds commonly used in the consensual sale of commercial real estate – especially deeds in jurisdictions other than one’s own. We found very few articles on the subject of special warranty deeds and hope this Report will begin to fill that gap.

This Report includes the current draft of a base PSA form as of December 31, 2022, along with other information that may be useful when using that form.
